The Failure of the 28-Clause Peace Proposal for Ukraine: Why Peace Negotiations Continue to Stumble

Europe felt a moment of respite on Monday, as the tension caused by the announcement of a new 28-point plan for ending the war appeared – momentarily – to have been contained. A Washington representative spoke of "substantial progress" after Ukraine-US talks in Geneva. On Monday night, the Kremlin made its response: an extensive attack of rocket attacks on Kyiv.

The Pattern of Peace Talks and Military Action

The succession of opposing developments captured the grim essence of the outgoing year. By day, political struggles are waged: optimistic declarations are issued from multiple capitals. Considerable effort is allocated on managing specific proposals. By night, Russian leadership brutally reminds the world that, for them, conflict continues to be the main instrument for achieving "settlement".

Nighttime Reality

As military strikes progressed into the early hours of Tuesday, the current condition of Ukraine's defenselessness was exposed. Ukraine is equipped to monitor rocket firings from across the border, a capability afforded by current data. From observation points, military aircraft that had been deployed to counter approaching aerial threats roared overhead – advanced fighter aircraft supplied to Ukraine by European allies.

Soon thereafter, Kyiv's air-defence systems activated: several firings fired to intercept a hostile projectile. This was a sophisticated defense system at work, probably provided by allied countries. Every launch shakes the surroundings, rattling buildings. The brief panic quickly transforms into grim resignation: perhaps the hostile projectile won't strike its target this time, sparing the city from ruin and additional electricity failures.

Continuous Dangers

Not long after, a automatic firearm engaged a drone in the vicinity, part of a rapid response unit – most likely Western-made equipment. Sadly, the projectiles didn't strike the enemy aircraft – it pressed on overhead toward its objective.

Intermittently, this persisted until dawn. Kyiv faced the morning news: several casualties, destruction and utility failures in numerous residences as a result of the evening attack. As customarily, everyone still went about their day – living the war. But those 24 hours demonstrated Ukraine's essential dependence on Western support – a dependence that European nations are demonstrably unable to replace in the near term.

Ineffective Peace Efforts

The comprehensive proposal from Washington provoked deep reactions, discussion and serious worry – and briefly redirected concern from Ukraine's major integrity crisis in years. Yet, we have experienced comparable situations, after prior negotiation attempts and international summits.

Every new proposal from Washington adheres to the consistent cycle: a negotiation push against Ukraine, which Kyiv, with partner nations, succeeds in resisting. They contain the crisis but never actually secure success. This pattern will, certainly, persist.

Tactical Assessments

It is convenient to criticize specific actors of persistently promoting Russian terms. But that does not seem to be the complete picture. US administration operates on a principle understood by seasoned negotiators: you cannot secure via talks what you have lost on the battlefield. The US administration believes that it is impossible to compel Moscow to surrender the territory that it presently holds in Ukraine's south or east.

The issue is that while acknowledging this situation, Washington does little to deter Moscow, through words or deeds, from assuming that the status quo will not change more in its advantage in the coming year.

Opposing Positions

Therefore, Russian leadership is certain that duration works to their advantage – that Ukraine and its allies are approaching exhaustion. Their reason to sign a deal that does not give them the largest achievable advantage is virtually nonexistent. There may be numerous efforts to end hostilities, but they will continue as long as Russia's leader remains supremely confident in the conclusion.

On the contrary, Kyiv believes that Ukraine can still persist, gradually sacrificing people and territory but averting a total frontline collapse until conditions improve in its advantage.

Current Realities

Factually, there are no actual prerequisites for a truce. Now, individual motivations are entering the equation: leadership ambitions to negotiate peace and secure international recognition, and Ukrainian leadership's twin challenges – on one hand, not to estrange crucial supporters, and on the other, to mobilize citizens around the national cause against any initiative Kyiv finds unacceptable, so that their attention does not move to domestic problems. And although their task will now be much harder after latest incidents, it remains highly unlikely that this will alter their fundamental strategy.

These opposing factors are driving the talks.

Summary and Prospects

It took a only one week to kill the suggested clauses of the most recent proposal. Aggressive and erratic handling of the matter by Washington, opposition by Ukraine and the remaining European nations, along with soothing efforts of representatives, and finally, latest revelations, all achieved their purpose.

While new initiatives based on established approaches are approaching, Kyiv, London and other European capitals should draw one fundamental conclusion: Ukraine and Europe will only be able to counter negotiation assaults from Washington that are founded on Moscow's terms and demonstrate particular unwillingness to alter the situation, if they maintain solidarity and strengthen their defence capabilities at a much faster pace. If they do, neither political nor armed coercion will be able to break them. In the meantime, Ukraine's capacity to counter nocturnal attacks will, for the foreseeable future, mainly require ongoing international assistance.
